This website is owned and operated by or on behalf of Add Foundation (AF) under the domain name www.addfoundation.in (the Website).
Your use of the Service (provided by AF), the Website, and the information, graphics, materials and any products or services offered on the Website (‘Material on this Website’) is governed by these Terms and Conditions and the associated Privacy Policy. By using the Website you agree to be bound by these Terms and Conditions and the Privacy Policy.
Definitions
· Bank Account means a valid deposit, checking or savings account with a financial or deposit-taking institution.
· Electronic Instruction means any electronic instruction, information, message, requestor communication issued or transmitted to AF through the Website.
· Material on the Website means any tools, calculation devices, software programs, games or other features which may assist You in conducting Payment transactions, or helpful hints or other information, which may be available on the Website.
· Nominated Card means a valid credit or charge card which You may use to transfer funds from as a Sender.
· Nominated Debit Account means a Bank Account which You may use to transfer funds from as a Sender.
· Payment means a transfer of funds from You to AF via the Website towards a charitable donation or for the purchase of products and services offered by AF.
· Service means the use of the Website to access information relating to AF’s activities, communicating with AF staff or other registered users on community forums or posting your comments on the AF blog or other online forums.
· You means the person who accepts and agrees to be bound by these Terms and Conditions, and in the case of a business, are binding the legal entity which operates that business, (whether that be a sole trader, partnership or incorporated body) and represent that you have authority to bind that business in this fashion.
Receipt of Payments
The legal entity accepting payments on this Website is referred to as ‘Add Foundation’ and registered as follows:
- Add Foundation is registered as non-profit charitable organization in the form of a Trust with Sub-Registrar, New Delhi having Registration no. 765, Book no. 4, Volume no. 866.
- Add Foundation is registered u/s 12Aof the Income Tax Act, 1961 having Registration no.AAHTA5810FE20211 and u/s 80G of the Income Tax Act, 1961 having Registration no.AAHTA5810FF20221.
- Add Foundation is registered with NITI Aayog, Government of India having Registration no. DL/2019/0243645.
- Add Foundation is registered with Ministry of Corporate Affairs, Government of India having Registration no. CSR00039106 for undertaking CSR activities in India
Donors in India
Donors in India can either donate through the Website or send a cheque directly to the Honorary Treasurer at the following address:

Donors domiciled in India may be entitled to a 50% rebate under 80G of the Income Tax. Act 1961 on their donation to AF. AF will provide a receipt for each donation if you have provided your full postal address to the treasurer by e-mail or other means.
Making Payments
You may initiate an online Payment to AF by providing the required information at the Website. This required information includes, but is not limited to:
- Your name, address and email address
- The amount of the Payment
- The credit card or bank account details to be debited.
You must have adequate funds available in your Nominated Debit Account or on your Nominated Card in order for the transaction to be processed. If You do not, then AF may recover from You any exception processing fees it incurs from any Bank or other financial institution or payment gateway platform. AF may deduct these amounts from any of your accounts, the details of which You have provided to AF, without any notice to You.
Your financial institution may charge you a fee for the Payment processed by AF to your nominated Card or Nominated Debit Account. AF will not be liable for such fees and charges.
Though AF may keep a record of the Payment transaction associated with Youfor the period specified, You are responsible for your own record keeping for financial planning, taxation or other purposes. To request a receipt for a payment to be sent to you, please provide a mailing address when making a donation and request a receipt by emailing AF’s Honorary Treasurer at connect@addfoundation.in.
Cancelling Payment
You may cancel certain Payments that have not yet been processed. AF may charge you a fee for cancelling the Payment. If the Payment cannot be cancelled as set out above, You cannot reclaim the Payment by initiating a chargeback via your financial institution.
Your other obligations
You represent and warrant that all information You provide to AF will be complete, correct and accurate in every particular. If you provide incorrect or inaccurate information, your ability to use the Service and the Website may be suspended.
You agree and warrant that You will only use the Service and the Website for bona fide and lawful purposes. You must not seek to access or alter any information on the Website to which you do not have authorization. In addition, you must not seek to use any software or electronic device to overload, crash or interfere with our system.
You agree and warrant that You will not use the Service or the Website in connection with any products or services that AF reasonably consider are illegal or brand damaging.
You may not distribute, modify, transmit, repost for commercial purposes, Materials on this Website without written permission of AF.

The Website may contain links to websites which are owned or operated by third parties independent of AF (Linked Websites). AF does not sponsor, endorse, or approve of the operators of Linked Websites, or material which is located on Linked Websites, including special offers, deals or promotions, or information, graphics and other material (Third Party Material).
Subject to any applicable law which cannot be excluded, AF makes no warranties or representations:
regarding the quality, accuracy, merchantibility or fitness for purpose of Third Party Material, or products or services available through Linked Websitesthat Third Party Material does not infringe the intellectual property rights of any person. AF is not authorising the reproduction of Third Party Material by linking Material on this Website to Third Party Material.

Whilst every effort has been made to ensure that information is free from error, AF does not warrant the accuracy, adequacy or completeness of Material on this Website, the Service or any other products or services offered on the Website. All information is subject to change without notice. AF does not guarantee that the Website or Linked Websites will be free from viruses, or that access to the Website, Linked Websites or the Service will be uninterrupted. All terms implied by law, except those which cannot be lawfully excluded, are excluded.
Limitation of Liability

Availability of the Website
As electronic services are subject to interruption or breakdown, access to the Website is offered on an ‘as is’ and ‘as available’ basis only. Upon termination, you will no longer be authorized to access or use the Website.

You may not frame any part of the Website without AF’s express written consent.
Acceptance and changes to Terms of Use
You acknowledge and accept that your use of the Website indicates your acceptance of these Terms and Conditions and the Privacy Policy.
These are the current Terms and Conditions. They replace any other terms and conditions for the Website published on the Website to date. AF may at any time vary the Terms and Conditions without your consent. You agree to submit to the non-exclusive jurisdiction of the courts of Delhi as applicable above.
Should any clause or part thereof of these Terms and Conditions be found to be void, unenforceable or invalid, then it is severed from this agreement, leaving the remainder in full force and effect, provided that the severance has not altered the basic nature of this agreement.
